Partner Visa

These visas are for the spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Partner visas also allow the holder to access Medicare and work in Australia.

These visas are granted in two stages. The first is a two year provisional visa. After this period, applicants are reassessed against the criteria for the permanent residency visa.

Eligibility

  • You must be married or engaged to be married or be in a de facto relationship with an Australian citizen or Permanent Resident oran eligible New Zealand Citizen;
  • You must be 18 or older when you apply
  • You must have an exclusive, committed, genuine and continuing relationship.
  • For a de facto relationship your relationship must have existed for at least 12 months immediately before you apply for the visa (unless in a registered de facto relationship within Australian Authority)
  • you and your spouse/partner must either live together, or live apart on a temporary basis only
  • You must meet health and character requirements.

Visa types

  • Partner Visa (Subclass 820/801) –Onshore Visa
  • you must be in Australia when you apply this visa.
  • Partner Visa (Subclass 309/100) –Offshore Visa
  • you must be outside of Australia when you apply this visa
  • Prospective Marriage Visa (Subclass 300/820/801)
  • It’s a temporary visa (Subclass 300) that enables you to move to Australia and marry your partner. You must be outside Australia at the time of lodgement and visa grant.
  • Once the 300 visa is granted, you’ll have 9 months to move to Australia, plan your wedding, get married and lodge a spouse visa (820/801)
  • During this time, you can leave and re-enter Australia as many times as you wish.
  • You intend to marry one another and can show evidence of your booked wedding

Depending on the type of subclass you are applying for and your individual circumstances, you will need to provide sufficient evidence to prove immigration that you meet the requirements of a Partner Visa.

Sponsor’s requirements

Your sponsor must:

  • be an Australian citizen, permanent resident or eligible New Zealand citizen
  • not have been sponsored for a Partner visa or Prospective Marriage Visa (Subclas30) by someone else within the last 5 years or
  • not have sponsored more than 1 other person for a Partner visa or Prospective Marriage visa (subclass 300)
  • not have sponsored another person on a Partner visa or Prospective Marriage visa (subclass 300) in the last 5 years
